What is a Misdemeanor in Fort Lauderdale, FL?

A misdemeanor is the name for a class of crimes that are lower than that of a felony, but more than just an infraction of the law, such as a not using a turn signal while driving. If one is charged with a felony in Broward County, Florida, the felony would be that of State of Florida law, or the United States law if a federal crime case. If under the State of Florida law, such as a charge at the Broward County Courthouse in Fort Lauderdale, it would be a crime that is punishable by death or imprisonment in a state penitentiary where the sentence terms exceeds 1 year. That said, a felony in Florida is a crime that is punished if convicted as at minimum one year and up to life in prison, or death. Florida has five different levels of felonies for crimes committed in the State, which are:

  1. Felony in the Third Degree – this is a crime punishable from 1 to 5 years, and a fine of up to $5,000, as well as any dollar amount additional in restitution to the victim to make them whole.
  2. Felony in the Second Degree – this is a crime punishable from 1 to 15 years, and a fine of up to $10,000, along with any restitution additional.

  4. Life Felony – this is crime that is punishable by 40 years to life in prison, and a fine of up to $15,000, as well as restitution to the victims if applicable and ordered by the court.
  5. Capital Felony – this is a crime that is punishable by death or life in prison without the possibility of parole in a state prison, as well as restitution that is ordered by the court for the victim.

*Drug Offenses – crimes of the drug trafficking nature have special rules that differ some in which felonies for trafficking certain controlled substances can have mandatory minimum sentences to ensure lengthy prison time, and fines of up to $500,000.
