What Are Prostitution or Solicitation Charges in Florida
In Florida, prostitution and solicitation (of a prostitute) are criminal offenses governed by both State of Florida statutes, and local Miami laws. These types of sex crime charges are generally involving the paying for, or attempting to pay for, sex. This payment could be monetary or some other compensation, like personal property, real property, or another type of compensation that increases the wealth of the person supplying the sex.
Florida Statutes sec. 796.07 provides key guidance on understanding what sort of conduct is illegal under the prostitution statute, such as conduct which provides to:
- offer to commit prostitution
- solicit prostitution
- purchase the services of anyone engaged in prostitution
- enter, reside, or remain in a place for the purpose of prostitution
- take or give directions to a person seeking to prostitute or solicit a prostitute
- receive another in to a place for the purpose of prostitution
- own or maintain a place for the purpose of prostitution and its activities to take place there
- agree to secure another for prostitution
- aid or abet any of the above
We aggressively defend the rights, future, and freedom of individuals accused of various types of sex crimes in Miami, including, but not limited to:
- prostitution
- solicitation of a prostitute
- public lewdness
- indecent exposure
- online solicitor and other internet sex crimes

Is Prostitution a Misdemeanor or a Felony in Miami, Florida
Prostitution charges across Florida, including in Miami Dade County, can be charged as either a misdemeanor or felony, depending upon the criminal history of the individual accused.
A first offense of prostitution can result in a second degree misdemeanor charge of prostitution, which could result in up to 60 days in the Miami Dade County, six months of probation, and a fine of up to $500. A second offense of prostitution will be filed as a first degree misdemeanor of prostitution and can result in a punishment of up to one year in the Miami Dade County Jail and a fine of up to $1,000. If the prostitution charge is a third or more offense, then each offense will be filed as a felony in the third degree for prostitution, making you a lifetime felon if convicted, and facing jail time of up to five years in a State of Florida prison, and a fine of up to $5,000.
Working to keep a conviction off your record, even if the first offense, is critical to preventing the increase charges down the road should you ever be accused of the matter again.
Were You Arrested in a Miami Police Sting Operation for Prostitution?
Were you arrested in a police sting operation for prostitution at a home, business, or massage establishment? Quite often law enforcement will set up a sting using under cover officers to coerce a solicitation. It could be that the evidence gathered in an operation by law enforcement such as this could be suppressed and ultimately the charge dismissed, or even allow for the charge to be negotiated to a non-sex crime. Give us a call at (305) 317-1529 to set up an appointment with our Miami prostitution defense attorney to discuss your particular case in detail to see if this is possible for your situation.
